Wrong. He was driving in 60 in a 30 hour zone, he failed a field sobriety test which means he was under the effects of drugs or alcohol (yes, it was under .08 but I am still taking that into account)...apparently he was taking marijuana and prescription pills and he also resisted a police officer.
