Is there an inconsistency regarding (the storyline) supreme court?

at the end of season 1 we see Mendoza nominated for associate justice of the supreme court, yet the episode entitled "Supremes" in season 5 we don't hear any mention of him (when one of the characters recites the names of all the supreme justices). so is this a inconsistency on the part of the writers?
