I am not a lawyer and know no more about law then what I have seen on crime serials and read in old P.I. novels. However because this topic is still an area of much discussion both in our modern culture and more importantly in this fandom I will try to keep my arguments within the confines of the rulebook that our justice system has labored to perfect for so long.

The question is of course "Is killing ever justified". It is a question that raises it's head at least ones in any serious debate started at this club. The act of murder weather it is committed by one character or another always has it's defenders and prosecutors and both have strong arguments for there respective sides.

During this article I'm going to take some of the most popular cases and using my limited understanding of the law (with the assistance of legal-dictionary.thefreedictionary.com) as well as my more extensive study of the OUAT debates and discussions on this topic and act as judge.

Case #1- Homicide of Graham, sheriff

Defendant: Regina

Defendant held victim in captivity against his will for unknown years due to a breach of contract. Most likely due to Stockholm Syndrome both parties became emotionally involved. When victim attempted to break free defendant reacted to the perceived betrayal by killing him.

Defendants Argument: Grahams murder was a crime of passion done in the spur of the moment by a damaged and heartbroken woman who could not bear the thought of losing him and who obviously shows grief and remorse for what she felt she had to do.

Plea: Crime of Passion / Temporary Insanity

Judge's Statement: While the defendant may have loved the victim crimes of passion do not excuse murder it merely eliminates premeditation. (See: link) However the forced imprisonment of victim leading up to the crime as well as other crimes perviously committed against the victim (assault, rape) do prove malice aforethought. (See: link) It addition to all this defendants charge would automatically be bumped up to first degree for killing a police officer. (See: link)

Verdict: Guilty - First Degree Murder

Case #1- Homicide of Milah, wife

Defendant: Rumplestilskin

Victim (wife of defendant) committed adultery and abandoned her husband and son. When defendant learned of this betrayal he murdered her and assaulted her lover leaving him permanently crippled.

Defendants Argument: After suffering such injustices and humiliation at the hand of this woman the defendant asked her to explain herself and received only more insults. At that moment all the suffering she had put him and his child though welled up inside him and he snapped.

Plea: Honor Killing / Infidelity, Crime of Passion / Temporary Insanity

Judges Statement: While honor killings as a result of infidelity may be an acceptable excuse for murder in countries where woman are viewed as property I would hope this fandom is above that sort of thinking. (See: link) Once again crimes of passion do not excuse murder merely eliminates premeditation and infidelity at least in most civilized countries is not a capital offense. (See: link)

Verdict: Guilty - Second Degree Murder

Case #1- Homicide of Cora Mills

Defendant: Snow White

Defendant when of sound mind planned and coordinated the murder of the victim in order to avenge past crimes committed by the victim as well as prevent any future crimes. In a spur of the moment adaption to the plan defendant used the victims own daughter as a proxy to deliver the killing blow.

Defendants Argument: Snow already knew what Cora was capable of doing and had to stop her before she killed her and everyone she loved.

Plea: vigilante justice / self defense

Judges Statement: Weather Cora deserved to die or not does not matter. Vigilante justice is not protected under the law. (See: link)The only people allowed to dish out justice are those who were appointed to do so and only after all procedures are met. As the victim was not posing an immediate threat to her person the defendant can not plea self defense. The appropriate course of action would have been to leave the apprehension of the victim to someone without a conflict of interest that was qualified to administer justice in an appropriate manner. (See: link)

The complexity of this crime proves that it was premeditated. The brutality of the plan also adds to it severity. (See: link) The defendants clean record as well as her obvious remorse and eleventh hour attempt to stop the crime do work in her favor, however...

Verdict: Guilty - First Degree Murder

Case #1- Homicide of Royal Guard

Defendant: David "Charming"

During a home invasion and attempted assassination/kidnapping defendant stabbed and killed the victim.

Defendants Argument: Charming was protecting himself and his family from someone that was threatening immediate bodily harm.

Plea: Self Defense

Judges Statement: There is really only one acceptable excuse for taking someone life in the eyes of the law and that is when someone is attempting to kill or seriously injure you or someone else (See: link). Self defense does not however excuse you from the emotional ramifications of taking a life which can be more unbearable then any justice a court can dish out.

Verdict: Acquitted - Self Defense

I may have appointed myself judge but as most of you know it is not the judge that has the last word but the jury. i'd like to issue you all a summons and invite you to deliberate on these cases in the comments.

For your benefit I've compiled some of my research in an link.

First and foremost Regina has done so much more good than he has. Regina spent 2 seasons working at redemption and I think it paid off whereas Rumple is still lying through his teeth to Belle about how he's a changed man as he goes off to murder Zelena...the woman Regina spared and actually kind of saved. Regina's redemption arc has been really successful to this point. Rump's was a joke. Okay he stabbed Pan and saved everyone at the cost of his own life. That was the right thing to do. However he turned around and went for vengeance again, something Neal wouldn't have wanted done in his name....

I have made one of these before and since it's pretty late where I'm living I haven't got time to give explanations for why I find them pretty, so I'm just going to order them :)

1.Ruby
2.Regina
3.Amara
4.Ariel
5.Aurora
6.Young Cora
7.Tinkerbell
8.Zelena
9.Older Eva
10.Milah and/or Jack

Please no rude comments like saying people are "ugly" or anything like that, or I will report the person who said it :)

Side note:
If Amara wasn't here, and it was just OUAT Emma would probably be here, but there wasn't room for her, considering how gorgeous I find Amara.

I didn’t get to say this to August or Cora before they died so I need to know I said this to Neal.

I love you, I’m proud of you, I’m proud of you and Emma and I couldn’t have asked for a better man to make my ship complete! You are a good man, who always tries to help his friends and look after your family. You have taught me never to give up hope as you haven’t gave up on finding Emma and Henry and just kept going. Emma might have a sweet son, Snow has her smart and brave daughter, Eva has a daughter who never lets go of hope, Cora has her two gorgeous girls but Milah and Rumpel have a far better child than any of those. You are sweet, smart, brave, gorgeous and you never let go of hope. You are all of them put together. Don’t stop fighting until the last minute. Die a hero.

This is a glossary of sorts to my article "Is Killing Ever Justified?". Please read it first link.

OUAT Legal Dictionary

"There are actually 4 kinds of homicide: Felonious, accidental, justifiable, and praiseworthy. It makes little difference to the victim which sort they die of; the classification is mostly for the benefit of lawyers."

By US definition:

homicide n. the killing of a human being due to the act or omission of another. Included among homicides are murder and manslaughter, but not all homicides are a crime, particularly when there is a lack of criminal intent. Non-criminal homicides...

I expect this will get quite a bit of criticism, so a disclaimer before I start: it is not my intention to bash Neal. I'm trying not to find reasons which aren't there and if I saying anything untrue, feel free to correct me. Please don't complain if I say things you just don't like, but if I get something specifically canonically wrong, tell me so.

This post is me trying to articulate exactly why it is I'm not fond of Neal. I'm simply trying to just lay out what it is about him that irks me while being as objective and impartial as I can. Some of this post will overlap with other articles and...

Did anyone else see the parallels between the compass in "Tallahassee" and the magic bean in "...And Straight On 'Til Morning"?

Both the bean and the compass are necessary tools to travel between the worlds and are a symbol of hope. Both items take a lot of hassle to procure - climbing the beanstalk and fighting the giant for the compass and growing and fighting Tamara and Greg for the bean.

In "Tallahassee" Emma has the compass and refuses to let Hook hold it before deciding to not to risk trusting him and chaining him up. She couldn't risk trusting him because she had to get back to Henry....

After saw the set pict, I have some question and this are some theories to answered that question, I hope you enjoy read it

1. Why emma the one who meet him in NY? Nael got the postcard, I honestly though after he receive that postcard, he immediately fly to storybrooke and search for emma

Theory 1
nael decide to move on. He doesn't know about henry and decided that emma is his past and need to stay as his past.

Theory 2
he feel guilty and can't face emma yet

2. Why emma in NY? why she willingly leave her family and storybrooke to meet someone who broke her heart?

Theory 1
He called and ask her...

I didn't write this...it makes sense though..

Olmpiias Wrote:

I think in the end we will find out Rumple manipulated the whole thing...Even down to Daniel's death by Cora and Regina's hatred of Snow..etc. Remember without the prior events, the Dark Curse, Invented by Rumple, would never have been used.

I think in the end Rumple will be the true villain, not Regina.

I agree. I think Rump knew Cora before Regina was even born. Since the show likes to remind us (read: drill it into our heads) that "evil isn't born, it's made" I think we will eventually see how Rumpel "made" Regina evil, possibly orchestrating...

My idea of a cool episode for OUAT is:

Cora uses a fireball spell to cast Regina's house on fire after evilly criticising her in Storybrooke and traps her inside the house.

Meanwhile Henry and Emma are watching the news and hear of a 'house fire in Storybrooke' and how a woman was trapped in the blaze! Henry and Emma
are shocked! Emma went to investigate (because it's her job as sheriff). Henry sneaks out after her to see if his other mum is okay, even though he thinks she's 'evil.'

Emma Spots Cora leaving Reginas house and questions her about the fire. Cora says cunningly: "Thats what she deserves!"...
