Young Hermoine Doing Underage Magic?

In the Philosophers Stone, before the sorting, Hermoine mentions that she has practised spells at home, even performing a few correctly. But the Ministry of Magic laws say a witch/wizard cannot use magic, legally, until they reach the age of seventeen.

Hermoine would have only been 11 years old...

technically the law states that once you start school...i think. But also because herione comes from a muggle family, and they probably wouln't have put too much of a strain on someone who doesn't know the rules. Whatconfuses me is at the start of HP 3 when harry does the lumos spell

when she repaired them in the philosopher's stone, they are on the hogwarts express. which technically could be considered 'in school'. BUT, in the chamber of secrets, she uses the oculus reparo spell again, but this time in diagon alley. not in school or on her way to school. = illegal underage use of magic 100%

It's later revealed that the Ministry can only learn where magic is used, not who used it. In magical family homes and places like Diagon Alley they rely on adult wizards and witches to prevent the kids from performing underage magic.
